01 Bespoke & Personalised Products
Rush specialises in bespoke and personalised sportswear. Our products
may be manufactured specifically to your requirements, including custom
designs, colours, club badges, sponsor logos, player names, initials,
squad numbers and other personalised details.
Because these products are made specifically for you, they cannot
normally be resold to another customer and cannot normally be cancelled,
returned, exchanged or refunded because you have changed your mind.
This does not affect your statutory rights where goods are faulty,
not as described or otherwise do not conform to the contract.
02 Payment & Cancellation
Payment is required before an order enters production unless otherwise
agreed by Rush in writing.
Once payment has been made and the order has been accepted,
the order cannot be cancelled due to a change of mind.
If you choose not to proceed after payment has been made, any payment
made is non-transferable and cannot be moved to another
order, customer, club, team or future purchase.
Nothing within this section affects your statutory rights.
03 Artwork & Final Approval
Where applicable, digital artwork and/or an order specification will
be provided for approval before production.
You are responsible for carefully checking all details, including:
- Garment design and colours
- Club badges and logos
- Sponsor logos
- Names and initials
- Squad numbers
- Sizes
- Quantities
- Spelling
- Positioning of personalisation
- Any other information shown or supplied
Once final approval has been given, no alterations can be made
to the order.
Approval authorises Rush to proceed with production using the
information supplied and approved by the customer.
Rush cannot accept responsibility for mistakes contained within
information or artwork that has been supplied or approved by the
customer.
Changes requested before final approval may result in revised artwork,
additional costs or changes to the estimated production time.
04 Colours & Digital Artwork
Digital artwork is intended to provide a visual representation of the
finished garment.
Colours displayed on phones, tablets, computers and other screens can
vary depending on the device, screen settings, brightness and
calibration.
The final printed or manufactured colour may therefore
differ slightly from the colour displayed on digital artwork.
Colours may also vary slightly between separate production batches
or repeat orders.
Reasonable colour variations of this nature are not considered
manufacturing faults.
05 Design & Manufacturing Tolerances
Rush garments may involve sublimation printing, cutting, sewing and
other manufacturing processes.
As a result, minor variations may occur between the approved digital
artwork and the finished garment. These may include small differences
in:
- Pattern positioning
- Print alignment
- Logo or number positioning
- Stitching
- Seams
- Garment measurements
- Colour
- Placement of design elements
Where these differences fall within reasonable manufacturing
tolerances and do not materially affect the appearance or intended
use of the garment, they will not be considered manufacturing defects.
06 Sizing & Sample Garments
Customers are responsible for selecting and approving the correct
garment sizes before placing their order.
Rush size guides are provided to assist customers when choosing sizes.
Customers should use the measurements provided rather than relying
solely on a player's usual clothing size, as sizing can vary between
manufacturers, garment styles and fits.
Sample Garments
Where sample garments or sizing samples are available, customers and
clubs are encouraged to use them to help determine the most appropriate
sizes before submitting their final order.
Sample garments are provided as a sizing guide only.
The customer remains responsible for selecting and approving the
final sizes ordered.
Where a player has tried on a sample garment and a size has subsequently
been selected and approved, Rush cannot accept responsibility if the
customer later decides that they would have preferred a different
size or fit.
There may be minor variations between sample garments and finished
garments due to normal manufacturing tolerances.
Where samples are loaned to a customer or club, they must be returned
to Rush in the same condition in which they were supplied, allowing
for reasonable handling and trying on.
Where agreed as part of the sample arrangement, customers may be
responsible for the cost of replacing samples that are lost, damaged
or not returned.
Incorrect Sizes
Because bespoke and personalised garments are manufactured specifically
for the customer,
incorrectly selected or approved sizes cannot be returned, exchanged
or refunded unless the garment itself is faulty or does not conform
to the order.
A garment being too small, too large, too fitted or too loose for an
individual player is not in itself considered a manufacturing fault
where Rush has supplied the size that was ordered and approved.
Rush cannot accept responsibility where:
- An incorrect size was supplied by the customer, club, player or parent.
- A player did not try an available sizing sample before their size was submitted.
- The correct size was manufactured but does not fit the intended player as expected.
- A customer changes their mind about their preferred fit after approval.
- A player's measurements or required size change between ordering and receiving the garments.
Once an order has been approved and entered into production,
garment sizes cannot be changed.
Nothing within this section affects the customer's statutory rights.
07 Team, Club & Bulk Orders
Where an order is placed by a coach, manager, club representative,
parent representative or another individual on behalf of a team or
club, that person is responsible for checking the complete order
before it is submitted or approved.
This includes checking:
- Player names and spelling
- Squad numbers
- Garment sizes
- Quantities
- Personalisation
- Club details
- Sponsor details
- Any other player-specific requirements
The person placing or approving the order is responsible for ensuring
that information supplied by players, parents, coaches or other club
members is correct.
Once an order has been approved and entered into production, Rush
cannot make changes because a player, parent, coach or club
representative subsequently discovers that incorrect information
was supplied or approved.
Where Rush has manufactured garments according to the information and
sizes supplied and approved by the customer, errors in that supplied
information will not be considered manufacturing faults.
08 Customer-Supplied Names, Numbers, Logos & Artwork
The customer is responsible for ensuring that all information supplied
to Rush is accurate.
Rush cannot accept responsibility for incorrect:
- Names
- Initials
- Spelling
- Squad numbers
- Sizes
- Sponsor information
- Logos
- Other information
This applies where the incorrect information was supplied or approved
by the customer.
Where customers provide club badges, sponsor logos, trademarks,
photographs, graphics or other artwork, the customer confirms that
they have the necessary permission or authority to use and reproduce
those materials.
09 Rush Designs & Intellectual Property
Unless otherwise agreed in writing, original designs created by Rush
remain the intellectual property of Rush Sportswear.
Customers may not reproduce, copy or provide a Rush-created design to
another manufacturer for reproduction without prior written permission
from Rush.
Club badges, sponsor logos and other intellectual property supplied by
customers remain the property of their respective owners.
10 Production Times
Any production timeframe provided by Rush is an estimate unless a
specific date has expressly been agreed in writing.
Production times begin once Rush has received everything required to
manufacture the order, including:
- Full payment
- Final artwork approval
- Confirmed sizes
- Player information
- Club logos
- Sponsor artwork
- Any other required information
Delays in supplying information or approving artwork may delay
production.
Rush will make reasonable efforts to meet estimated production times
but cannot guarantee completion or delivery by a particular date
unless this has expressly been agreed.
11 Delivery
Customers are responsible for providing a complete and accurate
delivery address.
Rush cannot accept responsibility for delays or failed deliveries
caused by incorrect or incomplete delivery information supplied by
the customer.
Once an order has been dispatched, delivery may be affected by
circumstances outside Rush's direct control.
Customers should inspect their order as soon as reasonably possible
following delivery.
12 Checking Your Order & Reporting Problems
Customers are asked to inspect all garments as soon as reasonably
possible after receiving their order.
For club and team orders, Rush recommends that the person responsible
for the order checks the garments before distributing them to
individual players.
If an item appears to be incorrect, damaged or faulty, customers are
asked to contact Rush
within 7 days of delivery where reasonably possible.
Please provide:
- Relevant order details
- A description of the issue
- Clear photographs showing the issue
- Details of the affected garment or garments
Reporting an issue promptly helps Rush investigate and resolve
manufacturing or fulfilment problems quickly.
The request to report apparent issues within 7 days
does not remove or restrict any statutory rights
the customer may have.
13 Faulty or Incorrect Goods
Bespoke and personalised products cannot be returned, exchanged or
refunded simply because the customer has changed their mind.
However, this does not affect the customer's statutory rights.
If an item is faulty, has a manufacturing defect or does not materially
match the approved order, the customer should contact Rush as soon as
reasonably possible with photographs and details of the issue.
Rush will assess the issue and, where appropriate, provide a repair,
replacement, refund or other remedy in accordance with the customer's
legal rights.
The following will not normally be considered manufacturing faults:
- Incorrect sizes selected or approved by the customer
- Customer-supplied spelling mistakes
- Incorrect player numbers supplied by the customer
- Change of mind regarding fit
- Minor colour variations
- Reasonable manufacturing tolerances
- Normal wear and tear
- Accidental damage
- Misuse
- Damage caused by incorrect washing or drying
- Failure to follow garment care instructions
- Damage occurring after delivery which is not attributable to a manufacturing fault
14 Care of Garments
Customers should follow the washing and care instructions supplied
with their garments.
Printed, sublimated and personalised sportswear should be cared for
appropriately to maintain its appearance and performance.
Damage caused by washing, drying, ironing or otherwise caring for
garments contrary to the supplied care instructions is not considered
a manufacturing defect.
15 Repeat & Additional Orders
Rush will make reasonable efforts to match previous orders when
producing additional or replacement garments.
However, separate orders may be manufactured at different times or
from different production batches.
Minor variations may therefore occur in:
- Colour
- Fabric
- Print
- Trim
- Construction
- Garment measurements
Rush cannot guarantee that fabrics, trims, colours or other materials
will remain available indefinitely.
16 Events Outside Our Control
Rush will not be responsible for delays or failure to perform caused
by events outside our reasonable control.
These may include:
- Courier disruption
- Severe weather
- Customs delays
- Supplier disruption
- Manufacturing interruptions
- Transport disruption
- Import or export delays
- Other unforeseen circumstances outside our reasonable control
Where such an event occurs, Rush will make reasonable efforts to
minimise disruption and keep the customer informed where appropriate.
17 Statutory Rights
Nothing contained within these Terms & Conditions is intended to
exclude, restrict or limit any consumer rights or remedies that cannot
legally be excluded under applicable UK law.
Where goods are faulty, not as described, not of satisfactory quality
or otherwise do not conform to the contract, customers may have
statutory rights regardless of the bespoke or personalised nature
of the product.
18 Acceptance of Terms
By placing an order and making payment to Rush Sportswear, the customer
confirms that they have read, understood and accepted these Terms &
Conditions.
Where artwork or order approval is required, approval confirms that
the customer has checked the design, sizes, quantities, personalisation
and other associated order information and authorises Rush to proceed
with production.
Customers should not approve an order until they are satisfied that
all information is correct.
